Go east on Becker to the overpass and took a few birdseye views of nothing - NOTHING - but groves.

The one building that is close to the interchange is far from dilapitated.

government interferes with the free market during a recession,
the longer we tend to be IN that recession. The ones in the
past where the government basically did nothing were relatively
brief, compared to those where they manipulated jobs, payrolls,
projects, the money supply, the tax rates, and the business
rules and regulations.

There's a lot of anxious capital sitting on the sidelines, waiting,
because investors don't know what the rules of the market are
this week, this month. Quit fiddling with the market, let it be

Outside

Sorry Greg, the area clearly DOES NOT fit the criteria for a CRA.

The roadway is not deteriorating, the sidewalks are not deteriorating, the streetlights are not deteriorating, the traffic lights and masts are not deteriorating. There is no grass growing in the streets. Your crap of "use it or lose it" doesn't fly!

There is NOTHING beyond the construction sites of Torrey Pines, VGTI but barren land. The land consists of overgrown pasture, overgrown groves, wetland, swamp land and trees. There were some cattle amongst the groves. Other than that, there is absolutely NOTHING in the area.

The area definitely DOES NOT fit the criteria of a CRA.

It does not fit the criteria for a CRA since there is no development in need of redevelopment.


But it does fit the criteria of a failed vision, the same vision Ms Berger is still taking credit for.

The lens crafter  needs a second opinion, other than fellow lens crafter  Hank Fishkind.

It's sad to realize just how small a person she really is.  A person of good character does NOT need to feel special nor do they need to pretend to be a wealthy person who lives within a "boca" vision.  The position apparently alters a weak persons view of life.

The laws and rules are written for a reason but that reason has become ignored.  The courts have allowed lawyers and local officials  Barf! to twist the intent and it's across the entire legal system in our country and this is simply another case of "legalized" corruption.

Is this what you mean by "twisting" the intent to suit them?

I wonder where they intend on putting the low to moderate housing?  We've been looking to try and find where they designated this in the new plans, and there don't seem to be any.  Maybe the apartments will qualify?

I just find it extremely odd that STAFF left off certain wording within the Resolution and neglected to include these same very words within the Findings of Necessity report as required.  Specifically STAFF eludes to Statute 163.355 within the Findings Report and then leaves out what doesn't suit them or the project?

The resolution must state that:
 
(1) One or more slum or blighted areas, or one or more areas in which there is a shortage of housing affordable to residents of low or moderate income, including the elderly, exist in such county or municipality; and

(2) The rehabilitation, conservation, or redevelopment, or a combination thereof, of such area or areas, including, if appropriate, the development of housing which residents of low or moderate income, including the elderly, can afford, is necessary in the interest of the public health, safety, morals,or welfare of the residents of (the City of Port St. Lucie, Florida.) such county or municipality.

History.—s. 6, ch. 69-305; s. 4, ch. 84-356; s. 4, ch. 94-236; s. 3, ch. 2002-294.
 
The UNDERLINED words are the ones within the Findings Report and within the Resolution. Words within brackets were added by the city.

On page 4 and 5 of the Findings of Necessity Report, STAFF presented:

"Pursuant to Section 163.355, Florida Statutes, entitled "Finding of necessity...", no city shall exercise community redevelopment authority without adopting a resolution "supported by data and analysis, which makes a legislative finding that the conditions in the area meet the criteria described in Section 163.340(7) or (8)."

The wording about housing for low to moderated income, including the elderly, is no where to be found within the Resolution.

Then there are those 2 little words "if appropriate."  Maybe it is not appropriate within Southern Grove to have low to moderate income housing?

I do know this, the Statute is very clear that "THE RESOLUTION MUST STATE THAT: (1), (2)"

I read that as a requirement of the Statute, both paragrahs (1) and (2) "the language" MUST be within the Resolution.

So why isn't it contained within the Resolution and the Findings of Necessity report?

And then Orr signs off as "APPROVED AS TO FORM:"

This whole thing just ticks me off because it DOES NOT MEET THE CRITERIA FOR A CRA.

I know in advance that common sense doesn't seem to count
anymore, but one common sense definition of a CRA would be
an area where rehabilitation or redevelopment is necessary
because the area is undesirable, and that said rehabilitation
or redevelopment would make the area MORE desirable.

Southern Groves is not undesirable, it is simply a stalled area
because of the recession. Welcome to the rest of the community,
and the rest of Florida. Now, get in line and wait for your shot
at success.

Excerpt from Resolution 11-R50

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ST LUCIE, FLORIDA AS FOLLOWS:

Section 1.  Findings. The CIty Council does hereby find:

         (a)  Based upon the data analysis presented to and considered by the City Council, the following conditions exist within the Area:

1.  Aggregate assessed values of real property in the area for ad valorem tax purposes have failed to show any appreciable increase over the 5 years prior to the findings of such conditions;
2.  Deterioration of site or other improvements; and
3.  Inadequated and outdated building density patterns.

        (b) The notices required by Section 163.346 Florida Statutes have been timely published or mailed in accordance with said statute.

        (c) Action must be taken immediately to prevent further blight and deterioration and to protect and enhance public expenditures previously made in the Area.

We will be going out again this weekend to take more pictures.  Since there is a claim that things are sliding downhill quickly, we just want to see how fast things are really going downhill.

Regarding your editorial, "It stinks": Not only does it stink; I believe it's illegal.

Too big to fail? No.

From the dead Core Communities maintains its nefarious influence on Port St Lucie. Same team, same players, different positions.

From the very top: BFC Financial Corp. Controlling company of Core, Levitt Corp., BankAtlantic Bankcorp — all financially or legally in trouble.

Levitt Corp. changed its name to Woodbridge. Levitt and Sons, wholly owned by Levitt Corp., went bankrupt. Core Communities was foreclosed upon. Alan Levan, CEO of BFC, just offered a settlement on a class-action lawsuit for securities fraud. BankAtlantic settled a class-action and was found guilty of violating the Securities and Exchange Act of 1934. Great management team, eh?

Now the latest: Port St Lucie created a community redevelopment district under Florida Statute 163 for Southern Groves, the criteria for which it doesn't meet in any instance. I believe it was a deliberate violation of the Florida statutes.

Why, you might ask? Because the city's back was against the wall. A previous city administration had the audacity to guarantee bonds with taxpayers' money, issued by a private corporation. Back against the wall or not, compounding an issue by allegedly breaking the law is not the answer. When the United States bailed out GM at least they exacted a price. Millions in stock and seats on the board. No such thing here.

This situation needs an independent investigation. Not by a hired consultant, but by the Florida Legislature's Office Of Program Policy Analysis & Government Accountability.

This costs the city nothing. The process requires the direction of a legislative officer or a committee. Because this CDD allegedly violates state law, the state attorney can be brought in.

In my opinion the improprieties and conflicts of interests of previous Port St. Lucie administrations could fill a book. But this one takes the cake and needs to be stopped.

Took a ride today.  Spent a couple of hours in Tradition.  Funny thing, we didn't spot any cows this time, no dilapated buildings, certainly nothing that was "blighted" along Community Blvd. 

There are no roads deteriorating, no cracking, no weeds spouting through them, or anything of that nature.  (Come visit my road - it is quite a different story!)

I do have one question.  Who paid for all of the pedestrian lighting along Village Parkway through Tradition to match the pedestrian lighting on Crosstown Parkway?

I am convinced that this area should NOT BE DECLARED A CRA. 

I wonder how all of the other citizens of our county feel about supporting this boondoggle in the making.

Besides the taxpayer, what are the choices?

My biggest "you're kidding me, right?" moment comes every
time I see this justification clause from our "BIG city" leaders:

1.  Aggregate assessed values of real property in the area for ad valorem tax purposes have failed to show any appreciable increase over the 5 years prior to the findings of such conditions;

and I keep thinking, that used to be a good rationale back
when an area meeting this definition STOOD OUT in comparison
to its surroundings, which were always appreciating in value. It
is no longer an exception to the rule, it IS the rule!

The more I read, the more the phrase "legalized corruption"
starts to sound about right. Port St. Lucie logic makes sense
once you fall down the rabbit hole.

The Southern Grove CRA Proposal is only the beginning -- it opens the door for CRA extension into the Riverland/Kennedy and Wilson Grove area.

THE SOUTHWEST PROJECT

Roadway
The Southwest Project consists of the construction of roadway, potable water, wastewater and stormwater improvements, as described below, within the benefit of properties within the Southwest Annexation SAD No. 1 (the "Southwest Project")

Contribution of $38,500,000 to the construction for the Becker Interchange at I-95
Contribution of $5,100,000 to the construction for the Tradition/Gatlin Boulevard Interchange at I-95 modifications project, including the expansion from four to six lanes and the FDOT approval.

Wastewater
Contribution of $2.268,878 to the construction costs of a new Glades Wastewater Repump Station
The design, construction of 16" wastewater force main along Village Pkwy from Tradition Blvd o Becker Rd.
The design, construction of a triple lift station, collection system to serve Southern Grove Development Plat #4

The estimated total capital cost of the Southwest Project being funded by the proceeds of the Southwest Assessment Bonds, the City is making a substantial investment in capital projects which will benefit the Development. Included among the capital projects which the City has contracted for are approximately $7 million in  improvements for the Becker Interchange at I-95, approximately $5 million in improvements for the Tradition/Gatlin Interchange at I-95, more than $2 million in potable water system improvements and a $40 million investment in the Torrey Pines Facility.

THE DEVELOPMENT
 The Southwest Project will provide a majority of the infrastructure for the 3,606 acre Southern Grove Development of Regional Impact (the "Development"), which comprises a portion of the Tradition Florida master-planned community and projected to be constructed over a 25 year period. The early stages of the Development will be primarily commercial in nature. The Development, which is the second phase of the Tradition Florida master-planned community, is the only portion of the Tradition Florida master-planned community subject to assessments of the Southwest Annexation SAD No. 1. The Tradition DRI, Southern Grove DRI and Western Grove DRI make up the three phases of the Tradition Florida master-planned community. The Development features a center for a burgeoning life sciences cluster that includes the Torrey Pines Institute for Molecular Studies (the "Torrey Pines Facility"), the Florida Center for Innovation and a proposed Martin Memorial Health Systems hospital, which recently received Certificate of Need approval from the State of Florida. This location offers optimal opportunities for scientific collaboration and clinical trials. Also in close proximity, including 250 acres controlled by the City of Port St Lucie, which could easily accomodate over 5.4 million square feet of associated industries.

The Development was annexed into the City in 2004 and the Development Order (DO) was approved by the City in September of 2006.

More bonds will be issued in the foreseeable future. What lender in their right mind is going to welcome these guys with open arms when it comes to obtaining funds? What are they going to use as collateral, besides the backs of every taxpayer? The vast majority of the land in the Southern Grove area falls under the agricultural category. The acreage consists of WASTELAND, MNCPL PROP, GRZNG SLD CP, UNCLSSFD, R/W ST RDS, POA and a few VACANT COMMERCIAL parcels. The Property Appraiser is being awfully generous with the Ag Credits. For the area being awfully "blighted" it certainly appears that the parcels are receiving in Ag Credits close to the amount that Core Communities a/k/a New Horizons St Lucie had invested per acre in purchasing the land.

Will be interesting to see if the Southern Grove CRA Proposal is any part of the agenda.

I took another leisurely drive around the proposed CRA zone yesterday, and NOTHING has changed.  Couldn't even find one cow grazing.  Did see some utility workers yesterday and could easily pick out the supervisors!  lol

But, the "use it or lose it" aspect of this?  And that things were "quickly deteriorating within the Grove?"  NAH.  I just don't see it, but I do see where the kids have been street racing.
